Nice classes, what they cover, and why the wrong class leaves you exposed.
Trademarks aren't registered in the abstract — they're registered for specific classes of goods and services. Understanding this is the difference between proper protection and a false sense of security.
The Nice Classification divides goods and services into 45 classes. Classes 1–34 cover goods (chemicals, clothing, food, etc.). Classes 35–45 cover services (advertising, software, finance, education, etc.). When you register a trademark, you register it in specific classes — not all of them. Your rights only cover the classes you register in.
Class 35: Advertising, business management, business administration. If you're running a SaaS platform, marketplace, or any service business, you're almost certainly here.
Class 42: Scientific and technological services, computer programming, software as a service. If you're building software, this is your primary class.
Class 38: Telecommunications, including online messaging and communication platforms.
Class 41: Education, training, publishing, entertainment. If you produce content, courses, or events.
Class 36: Financial services, insurance, banking. Fintech lives here.
If you register in Class 42 but your main business activity is Class 35, someone else can register your name in Class 35 and operate legally alongside you — causing customer confusion — and there's very little you can do about it. Get the class right from the start.
You can register in multiple classes in a single application. Each additional class adds to the fee but uses the same application process. If your product spans Class 35 and 42, file for both. The cost of getting this right is small compared to the cost of reregistering later or the exposure of being unprotected.
